Terms and Conditions
1. Scope of Application
1.1 These Terms and Conditions (hereinafter referred to as “T&C”) apply to all orders placed via the online shop www.donumaustria.com (hereinafter referred to as the “Shop”), operated by:

1.2 These T&C apply to consumers within the meaning of § 1 of the Austrian Consumer Protection Act (KSchG) as well as to entrepreneurs within the meaning of § 1 of the Austrian Commercial Code (UGB).
1.3 Any deviating terms and conditions of the customer shall not be recognized unless the seller expressly agrees to their validity in writing.
2. Contractual Partner and Conclusion of Contract
2.1 The purchase contract is concluded with the operator of the online shop (see section 1.1).
2.2 The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalogue.
2.3 By clicking the button “Order with obligation to pay” or a comparable button, you submit a binding order for the goods contained in the shopping cart.
2.4 The contract is concluded in the following steps:

Selection of goods and placing them in the shopping cart

Clicking the “Checkout” button

Entering billing and delivery address

Selecting the payment method

Reviewing all entered information

Binding submission of the order by clicking the button “Order with obligation to pay”

Confirmation of receipt by email (does not yet constitute acceptance of the contract)

Dispatch of the order confirmation by email (acceptance of the contract)
2.5 The contract text will be stored after conclusion of the contract and can be accessed by the customer via their customer account.
3. Prices and Shipping Costs
3.1 All prices are final prices and include statutory value-added tax.
3.2 In addition to the stated prices, shipping costs will be charged for deliveries outside Austria and Germany. The shipping costs will be clearly communicated again in the shopping cart and on the order page.
3.3 For deliveries to countries outside the European Union, additional costs may arise in individual cases (e.g. customs duties or taxes), which are not the responsibility of the seller and must be borne by the customer.
3.4 We reserve the right to make price changes. The agreed price applies to contracts already concluded.
4. Payment Terms
4.1 Payment may be made by:

4.2 If payment in advance is selected, our bank details will be provided in the order confirmation. The invoice amount must be transferred to our account within 14 days.
4.3 If payment is made by credit card, the amount will be charged when the goods are dispatched.
4.4 If the customer defaults on payment, default interest of 9.2 percentage points above the base interest rate shall be charged.
5. Delivery and Shipping
5.1 Delivery will be made to the delivery address specified by the customer during the order process.
5.2 Delivery area: Austria, Germany, Switzerland and other EU countries.
5.3 Unless otherwise stated, the delivery period is 3–7 working days from the conclusion of the contract (for advance payment, from receipt of payment).
5.4 If delivery of the goods fails due to the fault of the buyer despite three delivery attempts, we may withdraw from the contract. Any payments already made will be refunded to the customer without delay, minus any incurred shipping costs.
5.5 The risk of accidental loss and accidental deterioration of the goods shall pass to the customer as soon as the goods are handed over to the customer or to a person designated by the customer who is not the carrier.
5.6 Partial deliveries are permitted insofar as this is reasonable for the customer.
6. Retention of Title
The delivered goods remain the property of the seller until full payment has been received.
7. Warranty and Guarantee
7.1 The statutory warranty provisions pursuant to §§ 922 et seq. of the Austrian Civil Code (ABGB) apply.
7.2 The warranty period is two years from receipt of the goods.
7.3 Warranty claims do not exist in cases of only minor deviation from the agreed quality, minor impairment of usability, natural wear and tear, or damage occurring after the transfer of risk due to improper handling, excessive use, or unsuitable operating conditions.
7.4 Only our own information and the manufacturer’s product description are binding for the quality of the goods, not public promotions or statements made by third parties.

8. Right of Withdrawal for Consumers
Consumers have a statutory right of withdrawal.
The details are set out in our Withdrawal Policy.
9. Liability
9.1 Claims for damages by the customer are excluded unless otherwise stated in the following provisions.
9.2 This exclusion also applies to liability for the fault of vicarious agents and legal representatives.
9.3 The above exclusion of liability does not apply to damages resulting from injury to life, body or health caused by a negligent breach of duty by the seller or by an intentional or negligent breach of duty by a legal representative or vicarious agent of the seller.
9.4 Liability for damages resulting from an intentional or grossly negligent breach of duty by the seller or by a legal representative or vicarious agent of the seller also remains unaffected.
9.5 Liability under the Austrian Product Liability Act remains unaffected.
10. Copyright
10.1 All content of the online shop (texts, images, graphics, layout, logos) is protected by copyright.
10.2 The reproduction, editing, distribution and any kind of use outside the limits of copyright law require the written consent of the seller.
11. Data Protection
The processing of personal data is carried out in accordance with our Privacy Policy, which can be viewed at:

12. Dispute Resolution
12.1 The European Commission provides a platform for online dispute resolution (ODR), available at:

12.2 We are not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
13. Final Provisions
13.1 Contracts between us and the customer shall be governed by the law of the Republic of Austria, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as the protection granted by mandatory provisions of the law of the country of the consumer’s habitual residence is not withdrawn.
13.2 If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and the seller shall be the seller’s registered office.
13.3 Should individual provisions of these T&C be or become invalid, the validity of the remaining provisions shall remain unaffected.
